A Taste of Victoria Food Tours Inc.

Terms & Conditions and Liability Waiver

By purchasing tickets for and/or participating in the walking food tour(s) (“Tour”) offered by A Taste of Victoria Food Tours Inc. (operating as A Taste of Victoria Food Tours™) (the “Company”), you acknowledge and agree to the following terms. If you are under 19 years of age, a parent or legal guardian must accept on your behalf.

1. Voluntary Participation

Your participation in the Tour is voluntary. You confirm that you are in suitable health to participate and have no condition that would make participation unsafe for yourself or others.

2. Assumption of Risk

Tours take place in public areas and involve walking, crossing streets, exposure to weather, and consumption of food and beverages. You acknowledge risks of illness, allergic reactions, choking, slips/trips/falls, and all other risks inherent to public walking tours. You voluntarily accept all such risks.

3. Release of Liability

To the fullest extent permitted by law, I release and forever discharge A Taste of Victoria Food Tours Inc., its owners, employees, contractors, partners, vendors, and affiliates (“Released Parties”) from any and all claims or liabilities for injury, illness, property loss, or death arising from participation in the Tour, including those arising from the ordinary negligence of the Released Parties.

The Company’s liability to me is limited to cases of gross negligence or intentional misconduct. In any such case, the maximum amount of damages I may recover is limited to $250 CAD, which shall be my sole and exclusive remedy. The Company is not liable for any indirect, consequential, punitive, or special damages.

4. Food Allergies & Dietary Restrictions

You are responsible for clearly disclosing any allergies or dietary limitations before the Tour. The Company cannot guarantee accommodation of all dietary needs.

5. Consent to Medical Assistance

If required, you authorize the Company to seek medical assistance on your behalf. This does not create any duty for the Company to provide medical care.

6. Promotional Release (Optional)

The Company may use photographs or video taken during the Tour for promotional purposes. If you prefer not to appear in photos, please inform your guide before the Tour begins.

7. Severability

If any part of this waiver is found invalid, the remainder will remain enforceable.

Agreement

By participating in the Tour, you acknowledge that you have read, understood, and agree to this Waiver and Release of Liability.
